A virtual submission to the National Assembly’s Finance and Planning Committee is ongoing through a clause-by-clause online submission form. The form enables you to read each clause of the Finance Bill 2025 and indicate whether you support it, oppose it, or recommend amendments with space for explanations. You can include a comment that clearly explains how it affects you. This is the simplest way to voice your concerns online to your member of parliament, whether they are related to fuel levies, digital service VAT, essentials taxes, or housing deductions.
A submission was made by the Law Society of Kenya (LSK). They stressed in their memo that clause 47 of the Finance Bill infringes upon Article 50(2) of the Constitution's guarantee of a fair trial. The proposed change would make the appeals process pointless by allowing KRA to take enforcement actions while a taxpayer's appeal is still pending. For this reason, the LSK suggested that the clause be removed.
A similar submission was submitted by Anjarwalla & Khanna LLP, one of the top law firms in Kenya. They filed formal comments to Parliament opposing the same clause of the Finance Bill, which calls for the removal of Section 42(14)(e) of the Tax Procedures Act. The change would enable the Kenya Revenue Authority to send out agency notices, even in cases where the tax decision has been appealed by the taxpayer. The firm requested that the proposal be rejected because it would impede access to justice and clog the judiciary.
These instances demonstrate how institutions and professionals are actively influencing tax policy through the exercise of their constitutional rights. It is a call to every Kenyan to use the same platform and air their views and opinions on proposals that directly affect their daily life.
